Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the website located at thearchessuites.com (the "Site") and any reservation made for The Arches Suites, located at 222 East 135th Street, Bronx, NY 10451 (the "Property"), operated by The Arches Suites LLC ("we," "us," "our"). By using the Site or booking a stay, you agree to these Terms. If you do not agree, do not use the Site or book a stay.

2. Eligibility

You must be at least 21 years old to book a reservation or check in at the Property. The primary guest on a reservation must be present at check-in and must be a registered occupant of the room for the duration of the stay.

3. Reservations and Rates

  • Rates displayed on the Site are per room, per night, in US dollars, and are subject to applicable taxes and fees (including NYC hotel occupancy tax) unless stated otherwise.

  • A valid payment card is required to guarantee a reservation.

  • Reservations made through third-party channels (Airbnb, Booking.com, Expedia, Hotels.com, VRBO, and other OTAs) are also subject to that channel's own booking terms in addition to these Terms; where the two conflict as to that reservation, the OTA's terms govern the booking transaction and these Terms govern your use of the Site and conduct at the Property.

  • Rates and availability are subject to change without notice until a reservation is confirmed.

4. Cancellation, Modification, and No-Show Policy

The specific cancellation policy shown at the time of booking controls for that reservation.

5. Check-In / Check-Out

  • Check-in: 4:00 PM | Check-out: 11:00 AM. Early check-in/late check-out are subject to availability and may incur a fee.

  • The Arches Suites uses contactless self check-in — there is no staffed front desk. Check-in requires identity verification (a valid government-issued photo ID matching the reservation name, and in some cases a live selfie photo — see our Privacy Policy) before mobile/digital room access is issued.

  • The payment card used at check-in (or on file) must belong to, or be authorized by, the registered guest and may be used to secure incidental charges.

  • Guests unable to complete self-service check-in may contact [24/7 assistance line — insert] for help.

6. Occupancy, Pets, and Smoking

  • Maximum occupancy per room is set by suite type and posted on the Site at booking; occupancy above the stated maximum may be refused or charged an additional-guest fee.

  • Pets are permitted with a fee and restrictions; service animals as defined by the ADA are exempt from pet fees and restrictions (see our Accessibility Policy).

  • The Property is 100% non-smoking, including vaping, in all guest rooms and indoor common areas. A cleaning/remediation fee applies for violations.

7. Parking

Self-park garage parking is available on site at $30/day; reservation is required. Parking is at the vehicle owner's risk; we are not responsible for loss or damage to vehicles or their contents except to the extent required by law.

8. Guest Conduct and Property Rules

You agree to:

 

  • Comply with posted Property rules, applicable law, and reasonable staff/vendor instructions;

  • Not use the room or Property for any unlawful, unsafe, or disruptive purpose;

  • Be financially responsible for any damage to the room or Property beyond normal wear and tear, which may be charged to the payment card on file.

 

We reserve the right to deny or terminate occupancy, without refund, for violations of these Terms, illegal activity, or conduct that threatens the safety of guests, staff, or the Property.

9. Site Use

You agree to use the Site only for lawful purposes, including to browse, evaluate, and book accommodations. You may not: use automated means (bots/scrapers) to access the Site outside of normal browsing; interfere with the Site's operation or security; or misrepresent your identity or booking information.

10. Intellectual Property

The Site, including its text, graphics, photography/renderings, logos (including the Arches Suites "Keystone" mark), and design, is owned by or licensed to The Arches Suites LLC and is protected by copyright and trademark law. You may not copy, reproduce, or use our content or marks without prior written permission, except for personal, non-commercial use in connection with evaluating or booking a stay.

11. Third-Party Links and Services

The Site links to or embeds third-party services, including our booking engine [Mews] and OTA listing pages. We do not control and are not responsible for the content, terms, or practices of those third-party services; your use of them is subject to their own terms and policies.

12. Disclaimers and Limitation of Liability

  • THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

  • To the maximum extent permitted by law, The Arches Suites LLC is not liable for indirect, incidental, or consequential damages arising from use of the Site or a stay at the Property, except where such limitation is prohibited by law.

  • New York innkeeper law (General Business Law § 200 and related provisions) limits an innkeeper's liability for loss of guest property under certain conditions, but only if the required notice is conspicuously posted at the Property and, where applicable, a safe-deposit facility may be offered.

  • Nothing in these Terms limits liability for gross negligence, willful misconduct, or personal injury/death to the extent caused by our negligence, where such limitation is not permitted by law.

13. Indemnification

You agree to indemnify and hold The Arches Suites LLC, its owners, and its agents harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site or Property, except to the extent caused by our own negligence or misconduct.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles.

15. Force Majeure

We are not liable for failure to perform any obligation due to causes beyond our reasonable control, including natural disaster, government action, labor dispute, utility failure, or other emergency.

16. Changes to These Terms

We may update these Terms at any time. The "Last Updated" date above reflects the most recent revision. Continued use of the Site or a stay booked after changes take effect constitutes acceptance of the updated Terms; the version in effect at the time of booking governs that reservation.
